Terms of Service

1. Agreement to Terms

By creating an account or using pin360 ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Acceptable Use

You may use pin360 only for lawful purposes in connection with property marketing, surveying, facility management, or related professional activities. You agree not to:

• Upload content that infringes intellectual property rights, contains malware, or violates any applicable law.
• Attempt to access, probe, or test the security of our systems without authorisation.
• Use the Service in any way that disrupts, damages, or impairs availability for other users.
• Resell, sublicense, or commercially redistribute the Service without our written consent.
• Misrepresent your identity or affiliation when using the Service.

We reserve the right to suspend or terminate accounts that violate these provisions without prior notice.

3. Subscriptions & Billing

Access to pin360 is provided on a subscription basis. By subscribing you authorise us to charge your payment method on a recurring basis via Stripe. The following billing terms apply:

• Subscriptions are billed monthly or annually in advance, depending on the plan selected.
• A 14-day free trial is available for new accounts. No charge is made until the trial period ends.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
• We reserve the right to change pricing with at least 30 days' written notice.
• Failed payments may result in temporary suspension of access until outstanding amounts are settled.

4. Your Data & Content Ownership

You retain full ownership of all content you upload to pin360, including 360-degree images and PDF floor plans ("Your Content"). You grant us a limited, non-exclusive licence to host, process, and display Your Content solely as necessary to provide the Service to you.

We do not claim ownership of Your Content, will not share it with third parties except as described in our Privacy Policy, and will not use it for any purpose other than operating the Service.

5. 360-Degree Image Content Responsibility

You are solely responsible for ensuring that:

• You have the right to upload and use all 360-degree images and floor plans submitted to the Service.
• Images do not contain content that is unlawful, defamatory, obscene, or otherwise objectionable.
• Individuals who appear in 360-degree images have given appropriate consent where required by applicable law (including UK GDPR).
• Images accurately represent the properties they depict and are not used to mislead prospective buyers, tenants, or clients.

6. Intellectual Property

The pin360 platform, including its software, design, trademarks, and documentation, is owned by us and protected by intellectual property laws. Nothing in these Terms grants you rights in the platform itself beyond the limited licence to use the Service during an active subscription.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability. We do not guarantee that the Service will be error-free or that data will never be lost.

8. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total fees paid by you in the 12 months preceding the claim, or (b) £100.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, or if we are required to do so by law. Upon termination, your right to access the Service ceases and we will delete Your Content in accordance with our data retention policy (see Privacy Policy).

10. Governing Law & Disputes

These Terms are governed by the laws of Scotland and the United Kingdom. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland. If you are a consumer in another jurisdiction, mandatory local consumer protection laws may also apply.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
